Terms of Service

These Terms of Service ("Terms") govern your access to and use of servicebydesign.ai (the "Site"), operated by Service by Design LLC ("Service by Design," "we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. The Site is informational
The Site describes our services and lets you get in touch with us. Content on the Site is provided for general information only and does not constitute professional, legal, financial, or other advice, nor an offer or commitment to provide services.
These Terms cover your use of the website only. Any services we provide to a client are governed by a separate written agreement (such as a proposal, statement of work, or master services agreement). If there is a conflict between these Terms and such an agreement regarding services, that agreement controls.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Site.
3. Intellectual property
The Site and its content — including text, graphics, logos, the "Service by Design" name and marks, layouts, and code — are owned by or licensed to us and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable license to view the Site for its intended purpose. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any part of the Site without our prior written permission.
4. Acceptable use
You agree not to:
• use the Site in any way that violates applicable law or these Terms;
• attempt to gain unauthorized access to the Site, its servers, or related systems;
• interfere with or disrupt the integrity or performance of the Site;
• introduce malware or other harmful code; or
• scrape, harvest, or collect information from the Site through automated means without our permission.
5. Your submissions
When you contact us through the Site, do not submit confidential, sensitive, or proprietary information. Any information you send is handled as described in our Privacy Policy. You represent that the information you provide is accurate and that you have the right to share it.
6. Third-party links
The Site may contain links to third-party websites or resources. We provide these for convenience and do not endorse and are not responsible for their content, products, or practices. Accessing them is at your own risk.
7. Disclaimers
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components, or that any information on it is complete, accurate, or current.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, Service by Design LLC AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
9. Indemnification
You agree to indemnify and hold harmless Service by Design LLC and its owners, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your misuse of the Site or violation of these Terms.
10. Governing law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. You agree that any dispute relating to the Site will be brought in the state or federal courts located in Illinois, and you consent to their jurisdiction.
11. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Effective date" above. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
